Please read these terms and conditions ("Terms") carefully as they apply to all and any use of jodo.biz by any person (“User”) including without limitation;
- services associated with jodo.biz or otherwise supplied by Jodo (including without limitation all mailing lists, email lists, newsgroups, chatrooms, web mail, message boards and like forums run operated or controlled by Jodo ("Jodo Services");
- postings, advertisements, emails and other communications made to or using the Jodo Services ("Submissions");
- use of the Jodo Services; and
- payment.
By using jodo.biz you agree to be bound by these Terms. If you do not accept these Terms you should not register as a member or use jodo.biz, make Submissions or use any Jodo Services. About Jodo and jodo.biz
Jodo.biz Ltd t/a Jodo and jodo.biz is a company providing online services through which Users may advertise tasks which they require completing in return for payment (“Job Advertisers”) and which other Users may offer to complete and then complete in return for that payment (“Jodoers”). This process is known as “Tying the KnoT”. In relation to the foregoing Jodo also provides a forum for sharing information. Jodo is not a retailer.
Using jodo.biz
- In order to use jodo.biz you will need to register as a User for which you will need to submit various information and choose a Username and a password.
- You warrant and undertake that all the information supplied during registration is truthful, complete and correct. In the event that the information you have supplied is incomplete or incorrect you agree to indemnify Jodo against any loss or damage incurred by Jodo and any third parties who may suffer damage as a result of the information that you have supplied.
- You accept and understand that you are obliged to ensure that all information held about you by Jodo is up to date and that you can amend your registration details at any time through jodo.biz at http://www.jodo.biz/site/profile/
- By using jodo.biz you undertake that you have the necessary hardware, software and capability required.
- The username and password chosen by and issued to you upon registration with Jodo is personal to you in order to facilitate your use of and access to jodo.biz and shall not be disclosed to any third party without Jodo’s prior written consent. In the event that you believe your Username or password to have been compromised you undertake to inform Jodo immediately.
- You accept and understand that you are solely liable for any use of jodo.biz undertaken by use of your username and password whatsoever. DO NOT SHARE YOUR USERNAME OR PASSWORD WITH ANY OTHER PERSON OR ALLOW ANY OTHER PERSON TO USE YOUR ACCOUNT. JODO IS NOT LIABLE FOR ANY IMPROPER USE OF YOUR USERNAME, PASSWORD OR ACCOUNT.
- Once your membership has been verified you will be entitled to use jodo.biz and/or Jodo Services in accordance with these Terms.
- You may only use jodo.biz and/or Jodo Services once your registration is complete and accepted and your email address or contact details verified.
Job Advertisers
- Job Advertisers should describe details of the task required to be completed as fully and comprehensively as possible (“Job Advertisement”) and submit it to Jodo using the jodo.biz online system.
- All Job Advertisements are Submissions for the purpose of these Terms.
- Jodo is not responsible for any payment to a User in connection with a Job Advertisement nor does it supervise or manage any services advertised in Job Advertisements or the completion of any task.
- Jodo does not review the content of Job Advertisement or other Submissions and has no control over the accuracy or truth of the content of Job Advertisements or Submissions nor whether or not a Job Advertiser is entitled to or will enter a contract in connection with any Job Advertisement.
- By submitting a Job Advertisement a Job Advertiser is asking to use the Jodo Services on these Terms and agree to pay Jodo the applicable commission.
- Job Advertisers undertake that, when they post a Job Advertisement they have sufficient funds to fulfil the contract and will be bound by any terms stated in the Job Advertisement provided that those terms do not contravene or conflict with these Terms
- After you have submitted your Job Advertisement we will send you an e-mail to confirm that we have received it. This email confirmation will be produced automatically so that you have confirmation of your placing the Job Advertisement and its details. The fact that you receive an automatic confirmation does not necessarily mean that we will display the Job Advertisement.
- Once we have received confirmation that the sums due to be paid under the Job Advertisement have been received and that there are sufficient funds in your account to pay out under the Job Advertisement we will send you an automatic e-mail to confirm that Job Advertisement will be displayed.
- Once we have sent the confirmation email we may check the Job Advertisement or it may automatically be displayed on jodo.biz.
- In the event that we check it and the Job Advertisement breaches these terms or cannot be displayed it will not be.
- Jodo may remove a Job Advertisement at any time if in its reasonable discretion it is necessary for it to do so.
Job Advertiser’s Obligations
Before offering posting a Job Advertisement or any Submission on jodo.biz it is the responsibility of the Job Advertiser to ensure that your Job Advertisement complies with all relevant legislation and with these Terms and that you are able to meet your obligations arising from the Job Advertisement.
- All transactions are to be conducted in pounds sterling.
- Although membership and access to jodo.biz is offered without charge Job Advertisers are obliged to pay the Jodo Job Advertisement Fees. The Jodo Job Advertisement Fees Policy can be accessed by going to http://www.jodo.biz/site/docs/9/ The Job Advertisement Fees Policy may be subject to change at any time and upon notice posted to jodo.biz.
- Job Advertisers are responsible for writing and constructing the content of a Job Advertisement. As Job Advertiser you warrant that you own all intellectual property rights in the content of the Job Advertisement whether written or visual and you hereby grant to Jodo a perpetual, irrevocable royalty free, non-exclusive licence to use the content of the Job Advertisement on jodo.biz.
- As a Job Advertiser you undertake that:
- You will provide an accurate description of the task to be completed in the Job Advertisement;
- You will not cancel a Job Advertisement once another User has offered to undertake the task;
- You will not alter the Job Advertisement to make any material difference to it after once another User has began offered to undertake the task;
- You are responsible for all fees or costs incurred as a result of the use of jodo.biz including without limitation internet costs, postage, any income tax, VAT or similar tax that may be due;
- Where legally required you shall declare any income received as a result of your use of jodo.biz to the relevant authorities.
- It is forbidden (and in some cases illegal) to advertise for certain services to be provided and no User may use Jodo.biz for any illegal, unlawful or immoral purpose.
- Attempting to disclaim liability for authenticity or legality of a Job Advertisement is not permitted and will not enable a User to be released of any responsibilities under this Agreement or at law.
- Jodo shall and does disclaim and exclude liability to the maximum extent permitted by law in relation to any loss or damage arising as a result of use of jodo.biz and shall not accept any responsibility whatsoever for the content of any Job Advertisements.
Jodoers - Offering
- Jodoers who want to offer to complete a task described in a Job Advertisement should do so using the online system on jodo.biz.
- This will be the Jodoers’ “Offer” and is an offer to complete the task for the price stated, subject to these Terms.
- Any Offer that is made on jodo.biz constitutes a legally binding offer to contract with the Job Advertiser and may therefore NOT be retracted except on very limited occasions when by law you may be entitled to.
- After Jodoers have submitted an Offer we will send an e-mail to the Jodoer to confirm that we have received it and that it will be automatically forwarded to the Job Advertiser subject to these Terms.
- This email confirmation will be produced automatically so that the Jodoer has confirmation of the Offer details. We may decide, for any reason not to forward an Offer to a Job Advertiser.
- The fact that a Jodoer receives an automatic confirmation does not necessarily mean that the Offer will be accepted or that if the task is completed the Jodoer will receive the payment described in the Advertisement.
- All new Offers are deemed separate and each is treated individually.
Acceptance and Completion
- If a Jodoer makes an Offer the Job Advertisers will be entitled to accept or reject that Offer using the system on jodo.biz.
- If a Jodoers’ Offer is accepted by the Job Advertiser the Jodoer will be informed and once the Job Advertiser signifies acceptance a binding contract will exist under which the Jodoers must complete the task described in the Job Advertisement and the Job Advertiser is required to make payment on satisfactory completion of the task.
- Jodoers may decide to simply complete the task without making an Offer in which case the procedure described above will apply but may not be entitled to receive payment if the Offer is not accepted.
- Jodoers will be required to provide evidence of their having completed the task.
- No transactions relating to jodo.biz or the Jodo Services may be conducted outside of jodo.biz and no User may seek to do business in relation to a Job Advertisement except through jodo.biz.
Price and Payment
- Payment will be made only following completion of the task to the satisfaction of the Job Advertiser (which will be indicated by the Job Advertiser authorising payment of the sum due to you).
- The price and commission rates for all Jodo Services are as displayed at www.jodo.biz/fees (or as otherwise agreed by Jodo and you in writing) and include V.A.T at 17.5% where applicable.
- Prices are quoted in UK pounds – outside the UK your credit card company should exchange the amount charged to the currency of your country at the current rate.
- Payment of the sums due in any Job Advertisement are required to be made to Jodo before any Jodo Service is provided.
- Except for any payments due to Jodo in respect of the Jodo Services, Jodo holds any payments received from Job Advertisers on behalf of the Job Advertiser and not be required to release payment to a Jodoer unless authorised by the Job Advertiser or court of competent jurisdiction.
- Payments to Jodo may be processed online using a credit or debit card using Paypal. Paypal terms and conditions of use shall apply to all such payment and processing. We aim to debit money from a Job Advertisers’ account within three working days after receiving a Job Advertisement.
- Jodoers will receive payment into their Jodo account and Jodo will make payments out of Job Advertisers’ Jodo Accounts.
- Users may wish to make payments into their Jodo account by some other means in which case you should contact Jodo using the contact facility in Jodo.biz.
Payment, Refund and Non Payment Policy
- We want you to be satisfied whenever you use jodo.biz.
- Subject to these Terms, Jodo will make payment out of the payment due to the Jodoer if Jodo has received the funds from the Job Advertiser and the Job Advertiser authorises payment by signifying satisfaction with the completion of the task or as otherwise explained in these Terms.
- No payment will be made where a Job Advertisement ceases with no Offers being accepted by the Job Advertiser in which case the Job Advertiser will be refunded the sum held by Jodo LESS the Paypal / admin fee and any Jodo commission.
- In the event that a Job Advertisement ceases with no Offers being made to the Job Advertiser will be refunded the sum held by Jodo LESS the Paypal / admin fee but including and any Jodo commission.
- A Job Advertiser must specify any and all lawful and legally enforcable requirements he or she has in relation to the completion of a task including where necessary the standards of quality. Where a Job Advertiser does not do so or the terms of any agreement between the Job Advertiser and the Jodoer will be implied by and governed by English law to the fullest extent possible.
- If a Jodoer does not complete a task, provide evidence of completion or is a Job Advertiser is not satisfied with the performance of the task undertaken by the Jodoer then the Job Advertiser may decide at its discretion, not to authorise payment.
- Except as expressly stated in these Terms Jodo will not make any payment out to a Jodoer unless authorised by a Job Advertiser or required to do so by law, such as where we receive court order requiring us to make payment.
- Authorisation by a Job Advertiser may be implied from the content of the Job Advertisement and Jodo expressly reserves the right (but not the obligation) to make payment to a Jodoer where there is incontrovertible evidence that the task has been completed in accordance with these Terms and the terms of any Job Advertisement.
- Any and all disputes relating to the completion of a task and / or payment of any sum due will be conducted by the applicable Users independently of Jodo and all Users hereby indemnify and hold harmless Jodo in respect of any loss, damage, costs incurred or suffered by it in respect of any dispute concerning their Job Advertisements, Offers, payments, completion of a tasks or otherwise connected with the use of jodo.biz and any Jodo Services.
- We do not have any control or judgement over the completion of any task.
- If a Job Advertiser changes his or her mind within seven days of accepting an Offer the Job Advertiser may withdraw from the agreement and cancel the task UNLESS the services have commenced to do so a Job Advertiser must contact Jodo using the contact facility in Jodo.biz within 7 days of acceptance of the applicable Offer.
- Users’ statutory rights are unaffected.
- In the event of a dispute between Jodo and you, both parties shall use reasonable endeavours to resolve the matter amicably. Where a dispute arises between Users Jodo shall have no obligation to act as mediator or become in any other way involved in the dispute. Users warrant and undertake to use reasonable endeavours to resolve any disputes.
- You are encouraged to empty your Jodo Account regularly and before it becomes too full – unless you need those funds to meet your obligations to Jodoers.
Submissions
- Jodo is a mere conduit engaged in the business of providing a forum for third parties to communicate, offer and accept services and exchange information and is engaged in the transmission, storage, retrieval, hosting, formatting or translation of third party communications without selection or alteration of the content of the communication or any Submission.
- You agree and accept that Jodo has no responsibility to review the content of any Submissions or communications or contributions to (or which are part of) the Jodo Services all of which are made available on the basis that Jodo shall not be required to exercise any control or judgement of the content or the material posted or contained therein.
- The views expressed in any Submissions are the views of the individual contributors and not those of Jodo unless specified otherwise by Jodo. In particular but without limitation to the above Jodo is not responsible for and disclaims all liability in respect of any comments, views or remarks expressed in any Submissions.
- Jodo gives no warranty and makes no representation as to the accuracy, currency or validity of the information and material contained within the Submissions or the Jodo Services and shall not be responsible for any loss or damage caused as a result of any use of such material.
- Jodo has no control over the accuracy, truth, validity or content of a Submission nor whether the person making a Submission is who they say they are or entitled to make it.
- You agree and undertake that you will not post or transmit to, through or using the Jodo Services any statement, material or Submission that:
- is unlawful or which gives rise to civil or criminal liability;
- is abusive, illegal, pornographic, defamatory, libellous, untrue, discriminatory, obscene, inflammatory or racist;
- infringes upon the intellectual property rights of any third party;
- is technically harmful such as computer viruses, worms, logic bombs or other malicious software or harmful data;
- may otherwise cause damage, interruption or delay to the Jodo Services;
- is fraudulent, false or misleading;
- harasses any person;
- solicits, invites, encourages, advocates, incites or provokes any or all of the foregoing;
- contains, links to or directs persons to such material.
- Jodo reserves the right to refuse or remove any Submission for any reason including that it is contrary to these Terms.
- In any activity undertaken following use of and related to your use of the Jodo Services you will not in any way conduct yourself in a manner which is unlawful or which gives rise to civil or criminal liability or which might call Jodo into disrepute.
- You agree to indemnify and hold harmless Jodo against all liability it may have in respect of and arising out of your use of the Jodo Services and your Submissions.
- In the event that you believe that you have any action or claim against another User as a result of that User’s behaviour in the use of the Jodo Services you agree to pursue such an action or claim independently of Jodo and understand, agree and accept that you shall have no right to pursue Jodo for any claims, liability, damages, losses, costs and expenses, including legal fees, arising from or in any way connected with such right, claim or action.
- Jodo reserves the right to refuse or remove any Submission that it considers:
- To have been listed by a User who has supplied incorrect or false registration information;
- To be a task that is not eligible for advertisement under these Terms;
- To be inappropriate for any reason at its sole discretion.
- Despite the fact that we ask Users to warrant that information provided during registration or in a Submission or during a transaction is correct Jodo have no way of verifying this and as such you should take care and think carefully when using the Jodo Services. People are not always who they say they are and although this is regrettable you agree and understand that Jodo is not responsible for the acts or omissions of Users of the Jodo Services.
- Reference to email communication in these Terms includes messages sent through the internal communication system which is part of jodo.biz.
Liability
- Due to the nature of the Internet Jodo provides and maintains jodo.biz and the Jodo Services on an “as is”, "as available" basis and makes no promise that use of the Jodo Services and jodo.biz will be uninterrupted or entirely error free.
- We are not responsible to you if we are unable to provide the Jodo Services for any reason beyond our control and we shall be entitled to update and upgrade jodo.biz at any time without providing any prior notice.
- You will be responsible for any breach of these terms by you and if you use jodo.biz or Jodo Services in breach of these terms you will be liable to and will reimburse Jodo for any loss or damage caused as a result.
- These terms above shall not limit any rights you might have as a consumer that may not be excluded under applicable law nor shall they exclude or limit Jodo's liability for death or personal injury resulting from its negligence nor any fraudulent representation.
- Jodo will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control including without limitation Internet outages, communications outages, fire, flood, war or act of God or a third party hacking or otherwise unlawfully gaining (or seeking to gain access) to jodo.biz or any User account.
- Except as provided above we can give no other warranties, conditions or other terms, express or implied, statutory or otherwise and all such terms are hereby excluded to the maximum extent permitted by law. Subject as aforesaid and to the maximum extent permitted by law, Jodo excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Jodo and Jodo shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:
- any incorrect or inaccurate information on jodo.biz or Jodo Services;
- any interruptions to or delays in updating jodo.biz or Jodo Services;
- any act or omission of any User or third party;
- the infringement by any person of any Intellectual Property Rights of any third party caused by their use of jodo.biz or any Jodo Services;
- any loss or damage resulting from your use or the inability to use any Jodo Services or jodo.biz or resulting from unauthorised access to, or alteration of your Submissions, transmissions or data in circumstances which are beyond our control;
- any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong;
- any amount or kind of loss or damage due to viruses or other malicious software that may infect a User's computer equipment, software, data or other property caused by persons accessing, using or downloading jodo.biz, or from transmissions via emails or attachments received from Jodo or its licensees and affiliates;
- the availability, quality, content or nature of the other sites on the Internet that are owned and operated by third parties ("External Sites") to which any Jodo Service or jodo.biz link and web sites located on or through any External Site nor for any transactions involving External Sites (including as to 'cookies', personal data, confidential information, or purchases of domain names or other services). You should contact the site administrator or webmaster for those External Sites if you have any concerns regarding such links, web site or transactions;
- all representations, warranties, conditions and other terms which but for this notice would have effect.
Intellectual Property Rights, Copyright and Trade Marks
- The design, development, layout, concepts, source code and back end software of jodo.biz and Jodo Services, except where expressed otherwise, are the property of Jodo and all copyright, design rights, database right, patents, personality rights and any rights to inventions, know-how, trade and business names, trade secrets, logos and devices, trade and service marks (whether registered or unregistered) and any applications therefor ("Intellectual Property Rights") in them belong to and vest in Jodo, or are licensed to Jodo unless otherwise specified. All such rights of Jodo are hereby asserted and reserved.
- No person other than the rightful owner or licensee of such Intellectual Property Rights may:
- distribute, modify, transmit, re-use, re-post, or use any or all of the Jodo Services or the information contained therein for any purpose other than as set out above nor for public or commercial purposes without Jodo's or the relevant licensee's prior written permission;
- provide hypertext links, URL Links, graphic links, hyperlinks or other direct connection for profit or gain to the Jodo Services without Jodo's or the relevant licensee's prior written permission;
- display, publish, copy, print, post or otherwise use the Jodo Services and the information contained therein for the benefit of any other web site without Jodo's or the relevant licensee's prior written permission;
- process or otherwise use the information contained on or within the Jodo Services for any illegal or immoral purpose nor use or process the same unfairly.
- When making Submissions you agree and accept that Jodo may publish or otherwise distribute them and you therefore grant to Jodo an irrevocable, perpetual, non-exclusive right and licence to publish the Submissions and all content contained therein on or within the Jodo Services, on any other media whatsoever and in its own advertising and promotion.
- You alone shall be responsible for your Submissions and the content of your Submissions and all rights, duties and obligations that go with it and represent and undertake to Jodo that such Submissions do not involve, contain or include material that is likely to infringe the Intellectual Property Rights of any third party.
- You may not entitled to reproduce any of material contained within the jodo.biz or Jodo Service for any purpose except with the permission of the owner or as provided by law or as set out below.
- You MAY download and use the Jodo Services for your private, personal use only, provided that you retain all copyright notices and other proprietary notices contained on the Jodo Services. You may not sub-licence or deal in this right without Jodo's prior written permission.
- You therefore hereby undertake to Jodo to indemnify and hold harmless Jodo in full and defend at its own expense Jodo against all claims, liabilities, costs and losses whatsoever and howsoever incurred by Jodo its servants or nominees arising out of any claim made against it in any jurisdiction in the world for infringement of any Intellectual Property Rights of any third party caused by your use of the Jodo Services and your Submissions.
- Jodo, jodo.biz, the jodo.biz logo and the Jodo logo are trade names or trade marks of Jodo, the use of which is expressly forbidden by any other persons without the express permission of Jodo.
- Jodo makes no warranty or representation in respect of any other trade mark or trading name, symbol or device, all of which are hereby acknowledged. If you have any questions in relation to the use of any marks contained within the Jodo Services please contact Jodo using the contact facility in Jodo.biz.
Termination
- Jodo shall be entitled to terminate this Agreement and immediately remove, cancel or suspend access to and use of jodo.biz or Jodo Services and your username and password upon your breach of any part of these Terms whatsoever or in the event that Jodo reasonably believe you to have breached the Terms or in the event that Jodo, having used reasonable endeavours cannot confirm your identification; or you are adjudged to be insolvent, bankrupt or is unable to pay debts as they fall due, or make an assignment for the benefit of its creditors generally.
- Jodo may change or withdraw any part of the Jodo Services or jodo.biz, or may refuse you access to the web site at any time if we consider it necessary.
- Jodo shall be entitled to terminate this Agreement and immediately remove, cancel or suspend access to and use of the Jodo Services upon your breach of any part of these Terms whatsoever.
- Termination shall be without prejudice to Jodo’s other accrued rights.
